Lanesboro City Council
Monday; April 2nd, 2007 at 5:30 p.m.
Council Chambers

Present: Steve Rahn, Tom Dybing, Joe O’Connor, Kevin Drake and Vince Jeannette
Visitors: Dan and Maureen Anderson, Mark Brewster, Andy Drake, Mike Charlesbois, Lisa Brainard, Tom Manion, Gerry Evenson and Wanda Hanson

The meeting was called to order by Mayor Rahn.

Addition of Mark Brewster, requesting to vacate a street under housekeeping, was approved with a motion from O’Connor, second Dybing, motion carried.
The minutes from the March 19th meeting were approved with a motion from Drake, second Jeannette, motion carried.

Persons with business before the Council:

Mike Charlesbois; On-Sale Liquor License
Charlesbois explained that he was looking at different possibilities for his business such as staying open longer and hosting Christmas parties. To be able to do these things, he is asking if there is an on-sale license available, and if not, he wanted to be put on a list to get the next one available.
The maximum number of on-sale liquor depends on the size of the City; Lanesboro has four on-sale licenses and at this time they are all being used.
O’Connor made motion to put Chalesbois on a waiting list in case a license would open up, second Jeannette, motion carried.

Dan Anderson-TIF Agreement- Church Hill Properties
Anderson announced that with one more sale they will be going into the first phase of building on the first 2 floors, which will be 10 units.
Dybing made motion to approve the ‘Development Agreement” provided in the packet with the proper changes of dates, interest and rate, along with giving them the agreed upon access into Hillcrest Street for the underground parking, second O’Connor, motion carried.

Mark Brewster- Street Vacation on Elmwood and Dupont
Brewster requested to vacate the street on the west-side of his property, which is Fillmore Street. He stated that the City has never used this street and the neighbor has always mowed it.
The property is 300 Elmwood; legal description is Lot 13, Block 14 in the City of Lanesboro.
Drake made motion to approve a Public Hearing for the matter, Brewster is required to pay the fees for the hearing and the vacating a street fee, along with going in front of the Public Utilities Commission, in the case of utilities running through that area, second Rahn, motion carried.

Andy Drake-Water Issues in Park, Sidewalks, Street repairs for 2007
Water Issue in Park will not be solved until at least a small manhole and pump are put in, stated Drake. He stated that there is no way by just putting plants in that area that it will take care of the problem and that the road needs to be built up. The Council asked Drake to check on some prices for the equipment. Rahn recommended that the issue go before the Park Board first, once the prices are received.
Drake talked of some of the plans for street and sidewalk repair in the coming year.
The road to the Golf Club has to be fixed up to the pump house, along with the alleys behind the grocery store and theater.
He stated that we will do what we can with the money that is set aside.

Committee Reports:

PU- March 20th- Drake
Drake reported on the upgrades being done to the utility plant.
There will be tours of the light plant on April 28th.
After two more line upgrades he sated they should be in good shape.

P&Z-March 27TH-Dybing
Kevin Meyer is looking at is requesting to hold Flea Markets on his open lots on the flats.
They recommend John Pieper as a member for the committee. Dybing made motion to appoint John Pieper to the Committee, second by O’Connor, motion carried.
Two bed and breakfast licenses were approved, this fills all of the permits at this time.

EDA-April 2nd- O’Connor
O’Connor reported that there are new businesses in town, two bed & breakfasts and one home-based business with clock repair.
They also reviewed the 20/20 comprehensive plan.

Housekeeping:
County Ambulance Subsidy
Jeannette made motion to accept the contract which is the same as last year, second Drake, motion carried.
Workers Compensation Renewal
O’ Connor made motion to renew the worker’s compensation plan as is without covering elected officials or volunteer members of commissions or committees, second Dybing, motion carried.
Farmer’s Market Requests
O’Connor made motion to approve the changes in the policies of the market which includes to allow 4-H clubs as vendors and to expand the geographic eligibility area to 20 miles of Lanesboro, second Dybing, and motion carried.
Lodging Licenses
O’Connor made motion to approve the licenses of the presented B&B’s and lodging establishments, second Jeannette, motion carried.
Local Sales Tax Update
Dybing reported that Rep. Ken Tschumper and Sen. Sharon Ropes read their respective bills to state legislature.
Dybing noted it was not very encouraging; it appears they want to take care of issues through restructuring of property taxes, rather than allowing locals sales tax options.
Cable Channel Proposal from LWMG
Drake made motion to contract with Dave Harrenstein of LWMG for $200 per month for 2 years to outsource the management of the local cable TV channel, contingent that that they use the funds from the franchise fee from Ace, second O’Connor, motion carried.
All Hazard Preparedness Meeting
Information from the meeting was presented to the council for their review.
Board of Appeal
Reminder that the Board of Appeals and Equalization will be held at the beginning of the normal scheduled Council meeting on Monday, April 16th.
City Wide Clean up
April 28th will be the city wide clean-up.
Hazardous waste can not be collected, according to state rules, but can be brought to Fillmore County on May 1st from noon until five.

With no further business at 7:05, O’Connor made motion to adjourn, second Dybing, motion carried.
