Lanesboro City Council
Monday, April 3rd, 2006
Council chambers at 5:30 p.m.

Present: Steve Rahn, Kevin Drake, Joe O’Connor and Tom Dybing
Absent: Robert Norby
Visitors: Jan Meyer, Wanda Hanson, Roger Jorgenson, Duane Benson, Bob Thomas, Hal Cropp, Simon Cropp, Mike Bubany, Carla Noack, Tom Manion, Ted Reinhart, Nate Bremseth & Chad Wangen
Meeting Called to Order: Mayor Steve Rahn called the meeting to order, he asked for a moment of silence for the families of Andrew Ruen and Luke Peterson. Mayor made a note that due to the visitation occurring that the Council was going to try to move the meeting along and hopes that everyone will respect that.
Agenda: Drake made motion to approve the agenda with the addition of approval for the Lions Club Annual Raffle, second Dybing, motion carried.
Minutes: The minutes from the March 20th meeting were approved with a motion from Drake, second Dybing, motion carried.

The Public Hearing was called to order by Mayor Rahn:
Mike Bubany from David Drown & Associates representing the Commonweal Theatre, spoke about the TEFRA. The Commonweal has the opportunity to get a lower interest loan if the City supports the project. The City is allowed a 10 million per year borrowing limit and this would not put the City past this mark. Bubany believes that the Theatre will be asking for anywhere between 1.2 million and 1.5 million. Bubany asked if the Council had any Questions. There were no questions from the Council. Mayor Rahn asked the public if there were any questions. No questions were asked. O’Connor made a motion to close the public hearing, second
Dybing, motion carried.

Regular Meeting Reopened:
O’Connor made motion to open the regular council meeting, second Dybing, motion carried.

PERSONS WITH BUSINESS BEFORE THE COUNCIL:
A. Mike Bubany of David Drown & Associates and Hal Cropp from the Commonweal Theatre
Hal Cropp commented that the Theatre has to this date raised over 2 million to build the new theatre. He also asked that since there seemed to be no opposition he hoped that the Council would approve the resolution given to them. O’Connor made a motion to approve the resolution as follows: RESOLUTION RECITING A PROPOSAL FOR A COMMERCIAL FACILITY PROJECT GIVING PRELIMINARY APPROVAL TO THE PROJECT PURSUANT TO MINNESOTA STATUTES, SECTION 469.154 AND AUTHORIZING PREPARATION OF NECESSARY DOCUMENTS FOR THE COMMONWEAL THEATRE PROJECT, second by Dybing, motion carried.
B. Chamber of Commerce, Hal Cropp: Hal Cropp represented the Chamber and read aloud the letter from the Chamber that was in the packet giving support to improve the Ox Trail Road no matter what comes about with a possible new road by the Township. Torgerson also read a letter from Linda Sifford also supporting the improvement to the Ox Trail Road.
C. Ted Reinhart, Fountain Fire Department: Ted approached the Council and asked for a two year approval for a lease arrangement with the Lanesboro Golf Club to sell pull tabs. They would need a letter immediately if the Council approves this. O’Connor asked if any other local groups were interested in the pull tabs and Reinhart responded that they contacted others before asking the Council. Dybing made motion to allow the Fountain Fire Department to conduct pull tabs at the golf course, second Drake, motion carried.
D. Dan Anderson, Church Hill Property: Dan Anderson approached the council about the TIF district that had been created for his property. He asked if the district was still in affect and if he could get local investors to help, could he develop the condos himself. Torgerson stated that the TIF District is still open, but we have not had confirmation from the Church Hill Developers that they are defaulting on their development agreement. Bubany also mentioned that the TIF district has not been decertified so it would be a matter of putting a new development agreement together. The Council asked Torgerson and Manion to work on getting a final confirmation for default in the development agreement by the current developers. Anderson also asked if he could put some fill that the theatre will have available up in some of the areas. Rahn made motion to allow the fill from the theatre to be placed on City property for use by Dan Anderson with the direction of the location coming from Andy Drake, second Dybing, motion carried.
E. Mike Bubany, Capital Planning: April 17th, Mike Bubany will be presenting the start of the Capital Planning at this meeting.

COMMITTEE REPORTS:
A. Utilities - Drake
Drake noted how the Utilities focused on the ordinances, policies and procedures. They also overviewed the financials and discussed UMMPA.

B. Planning & Zoning - Dybing
The P&Z approved a building permit for Mindrum. Also Peter Torkelson is requesting a public hearing for two conditional use permits. The public hearing will be held on Monday, April 17th at 7:00pm.

Housekeeping
A. Liquor License Transfer
Drake made motion to transfer the Das Wurst Liquor license to Rick and Vicki Darling, second O’Connor, motion carried.
B. Street Department
O’Connor made motion to approve the following:
1) Purchase new backhoe based on prices given
2) Sell grader at auction
3) Have Council Tour in May
Second by Dybing, motion carried.
C. Mayor Conference
Drake made motion to approve all cost associated with Mayor Rahn’s Conference to be paid, second Dybing, motion carried.
D. Pay Equity
Dybing made motion to allow Mayor Rahn to have access to personnel files for pay equity, second O’Connor, motion carried.
E. Lodging Licenses
Drake made motion to approve lodging licenses for the list of B&Bs and Other Lodging, second Dybing, motion carried.
F. Street Lights
Torgerson will talk to Ace about when they will be putting in new lines and try to work with them.
G. Website
Torgerson noted that the website is almost done and everyone should take a look and make suggestions.
H. Comprehensive Planning
Carla Noack mention that the Community Meeting was a huge success and that Lanesboro is lucky to have the leaders that it does and that the next step will be a survey.
I. Lions Club Annual Raffle
Drake made motion to approve the Lions Annual Raffle, second by Dybing, motion carried.
J. Citizens Comments
No comments were made

With no further business, Dybing made motion to adjourn, second O’Connor, motion carried.
