Lanesboro City Council Regular Meeting
Monday, June 2nd, 2008
Council Chambers at 5:30 p.m.

Present: Steve Rahn, Joe O’Connor, Kevin Drake and Vince Jeannette
Absent: Tom Dybing
Visitors: Dillon Dombrovski (engineer), Andy Drake, Hal Cropp, Jade Wangen, Jan Meyer, Hal Cropp, Ted St.Mane, Charles St.Mane, Jeff and Mary St.Mane

REGULAR MEETING:
The regular meeting was called to order by Mayor Steve Rahn.
The agenda was approved, with the additions of Hal Cropp for a liquor license for the Commonweal Theatre and the St. Manes about their small cities grants and the removal of Scott Strom and the Removal of the line item with Bob Schrupp, with a motion by Jeannette, second by O’Connor, motion carried.
The minutes from the Regular Meeting on May 19th, 2008, were approved with a motion by O’Connor, second Jeannette, motion carried.

PERSONS WITH BUSINESS BEFORE THE COUNCIL:
Andy Drake: Waste Management Trucks damaging the alleys:
Drake wanted to let the Council know that currently the Waste Management trucks weigh 40,000 lbs empty. The trucks are damaging the alleys, which Drake feels will cost the City more money in the future. Whether or not Waste Management has smaller trucks or if they could pick up in the front of the homes was mentioned. Vickerman was asked to contact other cities to see what they do with their waste management; as far as who they contract through, how they pick up garbage and what size of trucks there are. Vickerman was also asked to contact Waste Management to find out if they have smaller trucks to use for the alleys.
Andy Drake: Rock Bids and Asphalt Bids
Drake brought forth the two bids from Orval Sorum and Sons’ for $7.45/ton and Knife River’s bid at $9.37/ton. O’Connor made a motion to appoint the bid to Sorum and Sons due to the lower bid, with Knife River as a back up, second Jeannette, motion carried.
Drake brought forth the two asphalt bids for the Park and Hillcrest areas. Knife River’s bid was $35,175 and Dunn Blacktop’s bid was $49,845. Drake made motion to approve Knife River’s low bid of $35,175, second Jeannette, motion carried.
Hal Cropp: Liquor License for the Commonweal Theatre:
Cropp noted that he was contacted by Vickerman about serving wine after theatre productions. Vickerman had noted to Cropp that a liquor license is required even if the wine is not purchased. Cropp noted that he wanted everything to be legal so he has filled out the paperwork. O’Connor made a motion to approve a wine license for the theatre, second Rahn, motion carried.
Chuck, Ted, Jeff and Mary St. Mane: Small Cities Grant/Loans:
Ted St. Mane approached the Council and asked the Council to forgive the balance due on the small cities loans. Ted noted that he believes in Lanesboro and would appreciate the City’s help in this matter. He noted how the fires began and the series of events that occurred after the fire. He feels that the City by its former Mayor and former City Administrator have given their word that the loans would be forgiven. St. Mane noted his appreciation for the fire department and the community members that have helped them. Jeff St.Mane approached the Council and noted that he was not here to “bust anyone’s chops”, but he felt he needed to clear the air. He stated he was very upset about the letter he received about foreclosing on his property if he did not pay his balance due. He was concerned about how the process came about. Manion noted that it was a legal notice that had to be done to start the proceedings to collect the money due to the City. Vickerman noted that the only forgiven amount that has been noted was for ½ of the sidewalks that the City Council agreed to pay for in the past. Jeff noted that he does not want to burn bridges, but wants to clear some items up. Both Jeff and Ted St. Mane noted that the City offered to help with items but then just stopped talking with them. Manion noted that once a legal notice of intent to sue, most lawyers will recommend not to speak of the lawsuit at hand, which was the case for the City. It is common practice. He also noted that the letter sent was a common 30 day notice for payment due. Ted St. Mane asked the Council to be good neighbors and give them some relief for all they have been through. Mayor Rahn noted that the letters may have been brisk, but it was a legal letter/procedure that had to be followed. He notes that he would have been upset as well to receive a letter like that. He noted he understands both sides. Vickerman explained the small cities grant process and noted that there are two options: one option is to forgive the balance due and the other is having the balance paid. Chuck St. Mane noted that there is no state legislation that covers whether it must be paid or not. Ted St. Mane felt it should be looked at case by case. O’Connor made a motion to forgive both loans for the St. Manes, second by Drake for debate. No further debate was discussed. No votes were in favor of the motion, all were against, motion was not passed.
Dillon Dombrovski – Yaggy Colby: Pleasant Street Storm Sewer Bid:
Dombrovski asked the Council to open up the bidding process for the Pleasant Street Storm Sewer system that was covered under the FEMA money for 2007. O’Connor made motion to authorize the bidding process, second Jeannette, motion carried.

COMMITTEE REPORTS:
PU: Kevin Drake – May 20th, 2008
Drake noted that the PU Commission had an audit report and noted that the Hydro would be back on June 10th.
EDA: Joe O’Connor – June 2nd, 2008
O’Connor noted that the St. Mane Theatre was present to talk about their projects they are working on. The Bunges were also at the meeting to discuss options for the open lots in town.

HOUSEKEEPING:
Ambulance Billing: O’Connor made motion to approve Ambulance Claims Processing as the new ambulance billing at $23.00/bill with a $500 set up fee, second Jeannette, motion carried.
Tree Ordinance: Vickerman asked if there were any changes proposed for the tree ordinance, it was noted that backyard trees should be the responsibility of the property owners for removal even if they are in the power lines.
Cell Phones: Vickerman noted that no other cities had a policy and that the cell phone could wait and the City would try to limit use of personal cell phones for City business.
Citizens Comments: There were no citizen comments.
